The Supreme Court has again ruled in favor of financial institutions, contrary to what everyone expected, especially after the latest ruling by the European Court of Human Rights in relation to the IRPH clause on mortgage loans.

The Supreme Court has again surprised in a decision on banking clauses, determining that, indeed, this clause should be considered non-transparent, as was presumed, but that, nevertheless, can not be considered abusive, so it is closed the possibility that consumers may claim a refund of what they have paid for the application of the index.

Recall that the European Court ruled on March 3 that the IRPH clause should be subject to transparency control, like the other clauses, contrary to what the Supreme Court had established in several judgments. This resolution seemed to open the door for the clause to be declared null and void due to abuse, as has already been the case with the “ground” clause, or the default interest clause in most mortgage deeds.

The ECHR had already ruled twice before, in relation to the “ground” clause, both in terms of its declaration as an abusive clause, and in terms of the consequences of this declaration of abuse, which the Spanish Supreme Court had initially limited, greatly reducing the amounts banks had to return to their customers.

Will the European Court have to rule for the fourth time in relation to the judicial treatment of mortgage clauses in Spain? It is likely that yes, as some consumer associations have already announced, as the four rulings that the Supreme Court has advanced this week offer, it is true, a possibility for the judicial claim of this clause, by declaring it non-transparent , but at the same time they lead to the conviction that, on a case-by-case basis, non-abuse can be declared and, therefore, that the bank will not have to return any amount to its customers.

Repetint una formula que ja hem vist en d’altres pel·lícules, la trama d’aquesta gira al voltant d’un judici per tal d’explicar la realitat social d’un moment històric concret.

A través de les declaracions dels diversos testimonis i del comportament i reaccions dels principals actors del procés judicial, com els acusats, els advocats, el fiscal o el jutge, es trasllada temporalment a l’espectador i se’l situa en el context on es van produir els fets que es narren, descrivint-ne les inquietuds de la població, els diferents interessos contraposats o les pressions que hi havia.

En el cas concret d’aquesta pel·lícula, se’ns presenta la societat dels Estats Units de finals dels anys 60, una època de tensions i conflictes socials que va suposar un punt d’inflexió en la cultura del poble nord americà i va comportar grans canvis a tots els nivells.

Amb la impopular guerra de Vietnam com a teló de fons, i diversos moviments ciutadans que s’oposen a les institucions tradicions de l’establishment (Hippies, Panteres Negres o Moviments d’estudiants d’esquerres), la conservadora administració Nixon, acabada d’arribar al poder, pretén instrumentalitzar el judici contra 7 dirigents d’aquests moviments socials, i els acusa de conspirar en contra de la seguretat nacional.

En aquest famós judici, els advocats defensors s’enfronten a tot el poder de l’estat, interessat en una sentència exemplar que serveixi com a advertència, i que no dubtarà en retorçar la llei i fer us de totes les eines de que disposa per aconseguir un veredicte de culpabilitat… Els sona?

Sota la direcció d’Aaron Sorkin, que també signa com a guionista, ens trobem amb una llarga llista de bons actors com Eddie Redmayne, Sacha Baron Cohen, Joseph Gordon-Levitt o Mark Rylance… potser no grans figures de la passarel·la de Hollywood, però reconeguts per la qualitat dels seus treballs, i que en aquesta pel·lícula no defrauden. Actuacions sòbries, solides, creïbles, que ens ofereixen personatges amb profunditat i matisos en mig d’una trama que busca tocar-nos la fibra i despertar, en l’espectador, moderats sentiments de ràbia i impotència.

Una feina coral de qualitat que, sense ser una obra mestre del gènere, aconsegueix entretenir i emocionar el suficient com per a que, el que subscriu, la consideri una bona pel·lícula.
